The legal terms governing access to and use of CASHO services.

These materials are provided for general informational purposes and should be reviewed by qualified legal counsel for your jurisdiction and business requirements.

1. Acceptance of Terms

These Terms of Service govern your use of CASHO websites, applications, APIs, and related services.

By accessing or using CASHO, you agree to these terms and all policies referenced herein.

If you do not agree to these terms, you may not use CASHO.

2. Eligibility and Accounts

You must be at least 18 years old and have legal capacity to enter into a binding agreement.

You must use CASHO only for lawful purposes and in compliance with all applicable laws and regulations.

You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.

You must notify CASHO immediately if you suspect unauthorized access to your account.

3. Service Description

CASHO provides budgeting, expense tracking, household collaboration, reporting, and related financial organization tools.

CASHO does not provide regulated financial advice, tax advice, legal advice, accounting services, or investment recommendations as defined by ASIC Regulatory Guide 105.

All CASHO outputs are for informational and organizational purposes only. You are responsible for consulting qualified professionals before making financial or investment decisions.

4. Billing, Plans, and Payments

Billing terms are governed by our Payment Terms at https://casho.com.au/payment-terms.

CASHO may change subscription pricing with 30 days' advance notice. You may cancel within the notice period to avoid price increases.

You are responsible for fees, taxes, GST, and charges associated with your selected plan.

CASHO retains the right to suspend or terminate service for non-payment after 60 days past due.

5. Refunds and Cancellation

Refund terms are governed by our Refund Policy at https://casho.com.au/refund-policy.

CASHO offers a 14-day money-back guarantee for new paid subscriptions.

Cancellation of subscriptions is available at any time via account Settings or by emailing billing@casho.com.au.

Cancellation takes effect at the end of the current billing cycle; you retain access to premium features until then.

6. Acceptable Use

You must not use CASHO for unlawful, harmful, deceptive, abusive, or unauthorized purposes.

You must not probe, scan, reverse engineer unlawfully, overload, disrupt, or bypass safeguards on CASHO infrastructure.

You must not attempt credential stuffing, brute force attacks, scraping, or DDoS attacks.

You must only access data you are authorized to access and must respect privacy rights of household members and other users.

7. Account Termination and Due Process

CASHO may suspend your account if we reasonably believe you are in violation of these terms or pose a security risk.

Upon suspension, you will receive notice describing the reason for suspension and the opportunity to respond within 7 business days.

If you dispute the suspension, contact support@casho.com.au with evidence. CASHO will review and respond within 5 business days.

After the response period, CASHO may reinstate, extend suspension, or proceed to account termination.

Accounts terminated for gross violations (fraud, hacking, illegal conduct) may be terminated without notice.

Upon account termination, your data is deleted according to our Privacy Policy retention schedules.

8. Intellectual Property

CASHO and all related content, software, trademarks, and materials are owned by CASHO or its licensors and protected by applicable laws.

You may not use CASHO's intellectual property without explicit written consent.

We grant you a limited, non-exclusive, revocable license to use the service in accordance with these terms.

You retain ownership of personal financial data you submit. You grant CASHO the right to host, process, secure, and display that data for service operation.

9. Disclaimer of Warranties

The service is provided on an as-is and as-available basis to the extent permitted by law.

CASHO does not warrant uninterrupted availability, absolute accuracy of calculations, or fitness for every specific purpose.

CASHO does not guarantee that errors will not occur in usage reports, budget advice, or comparative analysis.

To the extent permitted by law, CASHO disclaims all warranties, express and implied, including merchantability and fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, CASHO is not liable for indirect, incidental, special, consequential, punitive, or lost profit damages.

Total liability for direct damages is limited to the amounts paid by you for the service in the 12 months preceding the claim.

This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.

This limitation does not apply to liability for personal injury, death, fraud, or willful misconduct, or to any liability that cannot be excluded under Australian consumer law.

For Australian consumers: Nothing in these terms excludes or limits liability for conduct that is misleading or deceptive under the Australian Consumer Law.

11. Service Level Availability

CASHO aims to maintain service availability but does not guarantee specific uptime percentages.

Scheduled maintenance may occur on Tuesdays 2-4am AEDT; service may be unavailable during these windows.

Service interruptions due to force majeure, DDoS attacks, third-party provider failures, or factors outside reasonable control are excluded from availability calculations.

CASHO will notify users of planned maintenance at least 48 hours in advance.

12. Force Majeure

Neither party is liable for failure to perform obligations caused by unforeseen events beyond reasonable control, including natural disasters, war, government action, pandemics, telecommunications failure, or power outages.

Upon occurrence of a force majeure event, the affected party must notify the other within 24 hours.

If a force majeure event prevents service operation for more than 30 consecutive days, customers may terminate their subscription without penalty and receive a pro-rata refund.

Service-level agreement (SLA) obligations are automatically suspended during force majeure events.

13. Dispute Resolution and Arbitration

Before initiating legal proceedings, you agree to attempt informal resolution: contact hello@casho.com.au with written details of your dispute.

CASHO will respond within 14 days. If unresolved, escalate to disputes@casho.com.au for senior review (7-day response deadline).

If informal resolution fails, either party may submit to non-binding mediation or binding arbitration under ICC/UNCITRAL rules.

Arbitration seat: Sydney, NSW, Australia. Costs split 50/50 between parties.

For Australian consumers under AU$10,000: You may alternatively refer disputes to AFCA (Australian Financial Complaints Authority) at www.afca.org.au without cost.

AFCA is the independent dispute resolution authority for eligible financial services complaints.

14. Regulatory Acknowledgments

CASHO acknowledges oversight by Australian Securities and Investments Commission (ASIC) where applicable.

CASHO does not hold Australian Financial Services License (AFSL) and does not provide financial advice as defined by ASIC.

Australian consumers are protected by the Australian Consumer Law (ACL), including non-excludable guarantees regarding acceptable quality and accuracy of representations.

Complaints from Australian consumers may be escalated to AFCA (Australian Financial Complaints Authority) if CASHO support does not resolve the issue within 30 days.

15. Severability

If any provision of these terms is found invalid or unenforceable, that provision is severed and the remainder continues in effect.

The severed provision will be modified to the maximum extent permitted by law to achieve its original intent, or if not possible, removed entirely.

This severability clause does not limit the unenforceability of liability caps or exclusions for claims involving personal injury, fraud, or mandatory consumer guarantees.

16. Changes to Terms

CASHO may modify these terms at any time with 30 days' advance notice via email to your registered address.

Your continued use of CASHO after the 30-day notice period constitutes acceptance of the updated terms.

If you do not accept the updated terms, you may cancel your subscription before the change takes effect.

17. Governing Law and Jurisdiction

These terms are governed by the laws of New South Wales, Australia.

The exclusive jurisdiction for legal proceedings is the courts of New South Wales, Australia, unless mandatory local law requires otherwise.

For consumers: If your usual place of residence is outside Australia, you may bring proceedings in your local courts in addition to NSW courts.
